Tom Cruise is spending his 50th birthday without Katie Holmes and daughter Suri Cruise as he prepares for his divorce

Instead of blowing out the candles on his 50th birthday cake with Katie Holmes and daughter Suri, Tom Cruise is celebrating with divorce lawyers.

It hard to imagine anything worst than spending your birthday in divorce meetings but that's what Tom Cruise is facing after he and Katie announced their divorce last week.

This will be Tom Cruise's third divorce, following his earlier marriages to Mimi Rogers and Nicole Kidman.

The famous Scientologist has apparently called in the same group of lawyers that worked on his split from second wife Nicole Kidman.

The actor enlisted Dennis Wasser, the man who steered him through his £340million divorce battle with Nicole in 2001.

Another of Tom Cruise’s legal advisers said the star was hoping for smooth divorce and refused to reveal if Katie Holmes had been made to sign a pre-nup.

‘I would hope that it’s not a contentious matter,’ said litigator Bert Fields. ‘I know Tom is not a particularly contentious person.’

Katie Holmes is now believed to be with her Ohio-based lawyer dad, Martin Holmes, who has now joined her in New York.

According to TMZ, Katie Holmes may have decided to end her five-year marriage to Tom Cruise after he wanted to send their daughter Suri to Scientology ‘boot camp’ on her own ‘to be taught the ‘highest levels of Scientology’ with other children as young as five.
