HALLE BERRY'S EX WINS RESTRAINING ORDER AGAINST OLIVIER MARTINEZ

According to a written statement presented by Berry's attorney, Blair Berk, after a hearing in LA yesterday: 'The parties have reached an amicable agreement. There will be no further statements regarding this matter.'

Berry and Aubry have been embroiled in a bitter custody battle regarding daughter Nahla, whom Berry has been trying to move to France against the wishes of Aubry.

HALLE BERRY TO GET RESTRAINING ORDER AGAINST GABRIEL AUBRY?

Earlier this week, Aubry had obtained a restraining order against Berry's fiancé, Olivier Martinez, after the two men were involved in a bust-up outside Berry's home on Thanksgiving, which left both men injured.

Earlier this week, Aubry submitted graphic photos of himself with a swollen black eye, cuts around his other eye and bloodied fingernails, to the courts when he applied for his restraining order.

According to People magazine, Berry and Martinez didn't attend yesterday's hearing but Aubry was present, clad in a black coat and dark sunglasses to conceal his bruises.

Despite Aubry's allegations that Martinez had instigated the Thanksgiving Day brawl between the two men and had threatened to 'kill' Aubry, Los Angeles Police Department commander Andrew Smith told People that while the bust-up is still being investigated, his officers have concluded that: 'Aubry was the primary instigator.'

While both camps appear to have settled things, it's unclear what agreements were reached at yesterday's hearing - or if Aubry's restraining order still remains in effect.
