Gabriel Aubry drops custody fight with Halle Berry

Just weeks after the bitter battle began, Halle Berry’s model ex-Gabriel Aubry has withdrawn a custody petition, after the actress won a ruling in American courts.

Abruy had originally filed a petition to stop Halle taking their two-year-old daughter Nahla to New York, after landing a part in upcoming flick New Year’s Eve.

But yesterday, he dropped the petition, after judges gave the actress permission to move Nahla, while she filled out the work obligation.

Halle had withdrawn from the film – a sequel to hit flick Valentine’s Day – with her part being given away to Katherine Heigl. But now the actress is free to travel, it’s thought she’ll now take up another role in the movie.

‘We are pleased the judge took the time to deal with this very imminent and important issue,' a spokesman for the actress said yesterday. 'The judge read a great deal of paperwork and gave us time to argue. Halle is very pleased with the judge's order.'

Although the star’s ex has dropped his custody petition, it’s thought he’ll still try to seek joint custody, by filing a paternity action.

After ending their five-year relationship in April last year, Aubryfiled court papers for shared custody in December.

It had been believed that the couple had an amicable agreement over custody of their daughter, but things soon turned nasty, leading to a war of words between the pair.

‘Halle has serious concerns for her daughter's well-being while in the care of her father for any extended period of time and is prepared to take all necessary steps to protect her,’ an initial statement from the actress read.

'She has attempted to resolve these custody issues amicably with her daughter's father, Gabriel Aubry, directly, but given his lack of cooperation, Halle has no choice but to seek swift judicial intervention.’
