Halle Berry is preparing to take ex Gabriel Aubry to court, to fight for custody of their 2-year-old daughter, Nahla.

After ending their five-year relationship in April last year, Aubry filed court papers for shared custody in December. It had been believed that the couple had an amicable agreement over custody of their daughter.

Now, speaking to People, Berry's rep has confirmed: 'Halle has serious concerns for her daughter's well-being while in the care of her father for any extended period of time and is prepared to take all necessary steps to protect her.'

'She has attempted to resolve these custody issues amicably with her daughter's father, Gabriel Aubry, directly, but given his lack of cooperation, Halle has no choice but to seek swift judicial intervention,' the statement concluded.

The actress has now cleared her diary ready to face the courts, pulling out of new movie, New Year's Eve, which was set to start filming this week. Katherine Heigl has been drafted in as a replacement.

Since splitting from Aubry, Halle has been dating French actor Olivier Martinez, while her model ex was spotted on a string of dates with reality TV starlet Kim Kardashian.
