Kirsten Dunst has obtained a restraining order against an intruder who broke into her home

Christopher Smith will appear in court later this month, after Dunst's personal assistant carried out a citizen's arrest on him, when he was discovered trespassing in her house on 20 November.

The Spider-Man actress was not home at the time, but wrote to the court that the incident had left her 'quite frightened.'

Police documents revealed that Smith had made repeated attempts to get near Dunst, and that he had been found at her house on several occasions in recent weeks.

The incident rounds off a difficult year for the actress. She entered rehab in February, and later revealed that she had been battling depression.

She told E! Online, 'I was struggling, and I had the opportunity to go somewhere and take care of myself... Now that I'm feeling stronger, I was prepared to say something... Depression is pretty serious and should not be gossiped about.'
