Heather facing stint in jail
Heather Locklear has been formally charged with driving under the influence of drugs, following her arrest in September.
If the Melrose Place actress is found guilty, she faces penalties ranging from a fine to a six-month jail sentence.
The misdemeanour charge, filed by the District Attorney's Office in Santa Barbara, California, says the drugs were 'prescription medications'.
However, the charge does not specify what drugs they were or how much was taken.
'Lab tests showed she had no alcohol in her system and no illegal narcotics of any kind,' says senior deputy district attorney Lee Carter.
'We believe that the prescriptions she was taking could have impaired her ability to drive a motor vehicle safely.'
Heather, 47, was arrested in September after a tip off from an eyewitness who called emergency services and said the star was 'driving erratically'.
She was held on charges of driving under the influence of drugs and being under the influence of a controlled substance. The second charge was dropped after no illegal substances were found in her system.
Heather spent four weeks in July being treated for anxiety and depression.
A court date has been set for the end of January where she will have to enter a plea of guilty or not guilty.
