Sienna Miller wins court battle over nude photos

Marie Claire news: Sienna Miller Rex Features

Sienna Miller has won her High Court privacy action against the photographer who took nude pictures of her while she was on set of her latest movie.

The actress had sought default judgement and a permanent injunction against Warren Richardson, who snapped her while she was filming Hippie Hippie Shake – a movie about Oz editor Richard Neville, while on a private estate in Surrey.

Sienna’s counsel, David Sherborne, told the court the actress was ‘extremely distressed’ about the ‘highly intrusive’ pics of her stripping off and jumping into a lake.

The scene, says Sherborne, was plainly private and Sienna had a reasonable expectation that it would be kept so.

Sherborne told the Daily Mail: ‘Her distress was further aggravated, not only by the flagrant disregard of her rights, but the context in which the photos were taken - the constant climate of harassment and intrusiveness which she has had to suffer, particularly from the paparazzi in frightening and relentless attempts to get photos of her, exceeding what could possibly be expected to be tolerated, even given her high profile as an actress.’

Mr Richardson, who represented himself, said he would agree not to use the photos. He said he worked for Xposure for a small percentage and was obliged to give them his pictures, although he had no power over their sale.

Sienna has already settled her case against News Group Newspapers and Xposure Photo Agency, who paid her a total of £37,500 damages and promised not to use the photos again.

why is it the public feel celebrities are their property. If she was skinny dipping then she's an adult and should be able to do as she pleases without creeps taking pictures. If it was a scene from the movie and she was unaware the creep was taking photos of her then he deserves to be in court. Celebrities use the media but the public need to stop thinking they own them.
We have enough messd up celebrities in this world. Back off Kate.

Was she nude for a scene or was she skinny dipping? If it was for the movie, then what is the problem, we will all see it when her movie comes out. If she was taking a private plunge then she should keep her clothes on in future. Either way, she is a publicity seeking actress who is now complaining.
