Jim Toth, Reese Witherspoon's husband, is said to be feeling awful that he got the actress involved in his alleged DUI

Reese Witherspoon's husband, Jim Toth, is said to be feeling 'awful' that the actress was arrested in Atlanta over the weekend.

According to People, the talent agent feels responsible for getting Reese involved when he was pulled over on suspicion of driving while intoxicated.

Toth 'feels awful that he involved Reese in the situation,' a source told the US magazine. 'He made a bad decision and it certainly made things worse that he dragged her into it.'

The couple were arrested and briefly jailed early Friday morning – he for DUI, she for disorderly conduct after arguing with a police officer.

The Oscar-winning actress has publicly apologised for her behaviour that led to her arrest, saying: 'I clearly had one drink too many and I am deeply embarrassed about the things I said.

'It was definitely a scary situation and I was frightened for my husband, but that is no excuse.

'I was disrespectful to the officer who was just doing his job. I have nothing but respect for the police and I'm very sorry for my behaviour.'

The couple's court hearing was originally set for Monday morning but has been rescheduled for May 22.
