Stella McCartney wins Nude legal battle
By Lucy Hutchings on Friday 21 August 2009
Stella McCartney has won the right to name her new perfume STELLANUDE, following a legal battle with Bono's wife, Ali Hewson.
Ms Hewson, who owns a beauty brand entitled NUDE, took action against the fashion designer, claiming trademark infringement for Stella's use of the word 'nude.'
She called for an emergency injunction to halt the release of Stella's new fragrance, claiming she owned the trademark for NUDE throughout Europe.
McCartney will now launch her new scent this weekend, after the courts ruled that an injunction would cause 'massive disruption' for McCartney's business, and would cost millions.
Mr Justice Floyd, the judge presiding over the case stated: 'It seems to me that, in this particular case, the likely damage to (Stella McCartney Limited) and L'Oreal if an injunction is wrongly granted outweighs the damage to (NUDE) if it is refused.
'The effect of an injunction wrongly granted against (Stella McCartney) would be to cause a massive disruption to their business, and probably cause them to abandon use of the brand altogether.'
The news will come as a huge relief to McCartney - £4.1 million worth of STELLANUDE had already been produced.
This will not be the end of the battle though. The rock royalty will be due back in court later this year, to thrash out the matter.
